Welcome to The Woo Crew! Please read these terms and conditions carefully before engaging our services. By using our services, you agree to these terms and conditions in full.
1. Client Responsibilities
- It is the client's responsibility to perform daily backups of their website, including but not limited to product data, customer information, and settings.
- The Woo Crew will not be held liable for any loss, damage, or corruption of data due to insufficient backups or failure to maintain adequate backup procedures.
2. Service Scope
The Woo Crew provides maintenance, optimization, and product management services for WooCommerce websites as outlined in the service agreement. These services may include:
- Product updates (adding or editing products)
- Site maintenance (technical support, performance optimizations)
- Custom development (special features or functionality)
Any additional requests outside the agreed scope may require a separate agreement and incur additional charges.
3. Limitation of Liability
- The Woo Crew shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of our services.
- Our liability for any direct damages shall be limited to the total amount paid for the service in question. This liability cap ensures that clients are reimbursed for the specific service costs without exceeding the amount paid for that service.
4. Payment Terms
- Clients engaging in the "3-Hour Offer" promotion must pay the $20 upfront to initiate the project. (This offer is available for new clients only.)
- After the initial 3 hours of work, clients will be billed per hour for additional services. Invoices for ongoing work will be issued and are due within 7 days of receipt.
- Billing will also be triggered when an agreed-upon hourly cap is reached during the service period.
5. Refund Terms
- Clients who engage in the "3-Hour Offer" promotion are eligible for a full refund of the $20 paid if they are not satisfied with the service after the 3 hours of work.
- Refund requests must be made within 5 workdays after the review checkpoint following the completion of the service.
6. Confidentiality
- The Woo Crew respects your privacy and will not share your personal information or website data with third parties without your explicit consent, except as required by law.
7. Service Availability
- While The Woo Crew endeavors to provide uninterrupted service, we do not guarantee that services will always be available or error-free due to unforeseen technical or third-party issues.
8. Termination
- Either party may terminate the service agreement with written notice. Fees for work completed prior to termination will remain payable.
9. Force Majeure
- The Woo Crew shall not be held liable for any failure to perform services due to circumstances beyond our reasonable control, such as acts of nature, government regulations, or third-party failures.
10. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising shall be resolved in the jurisdiction of Pretoria, South Africa.
